Terms of Service

These Terms govern your use of LandlordIQ. Please read them — we've written them in plain English and kept the legalese to a minimum. By creating an account, you agree to these Terms.

Acceptance of Terms

TL;DR — By creating a LandlordIQ account, you agree to these Terms. If you don't agree, don't use the service.

These Terms of Service (“Terms”) constitute a legally binding agreement between you and LandlordIQ, Inc. (“LandlordIQ,” “we,” “us,” or “our”) governing your access to and use of the LandlordIQ platform and services.

By accessing or using LandlordIQ, you represent that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms. If you are using LandlordIQ on behalf of a business entity, you represent that you have the authority to bind that entity.

We reserve the right to update these Terms at any time. We will notify you of material changes by email. Your continued use of the service after the effective date of any changes constitutes your acceptance of the updated Terms.

Account Responsibilities

TL;DR — Keep your login credentials secure. You're responsible for all activity under your account. Use a strong, unique password.

You are responsible for:

  • Maintaining the confidentiality of your account credentials and not sharing your password with any third party
  • All activity that occurs under your account, including any actions taken by people you grant access to
  • Providing accurate and current information when creating your account
  • Notifying us immediately at security@landlordiq.com if you suspect unauthorized access to your account

LandlordIQ will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

Subscription & Billing

TL;DR — Payments are processed by Stripe. You can cancel anytime. On cancellation, you keep access until the end of your billing period and can export all your data.

  • All paid subscriptions are billed monthly or annually in advance. Payments are processed securely by Stripe. LandlordIQ never stores your payment card details.
  • Subscriptions auto-renew unless you cancel before your next billing date. You can cancel at any time from your account settings.
  • On cancellation, your paid access continues until the end of your current billing period. We do not offer prorated refunds for partial periods.
  • You can export all your data (transactions, reports, property details) at any time, including after cancellation, for a period of 30 days.
  • We reserve the right to change pricing with 30 days notice. Price changes will not apply to your current billing period.

Acceptable Use

TL;DR — Use LandlordIQ for lawful purposes related to managing your rental properties. Don't try to break it, reverse engineer it, or use it for anything illegal.

You agree not to:

  • Use LandlordIQ for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the service, other users' accounts, or LandlordIQ's servers or infrastructure
  • Reverse engineer, decompile, or disassemble any part of the service
  • Use automated tools, scrapers, or bots to access the service without our written permission
  • Upload or transmit any malicious code, viruses, or other harmful content
  • Use the service to store or process data relating to properties you do not own or manage
  • Resell or sublicense access to LandlordIQ without our prior written consent

Financial Data Disclaimer

Important — LandlordIQ provides financial tracking tools, not financial advice. All metrics are for informational purposes only and do not constitute investment, tax, or legal advice.

LandlordIQ calculates financial metrics (including cash flow, cash-on-cash return, cap rate, NOI, and equity) based on the data you enter into the platform. The accuracy of all metrics depends entirely on the accuracy of the data you provide.

LandlordIQ is not a licensed financial advisor, investment advisor, tax advisor, or attorney. Nothing in LandlordIQ should be construed as:

  • A recommendation to buy, sell, hold, or refinance any property
  • Tax or accounting advice
  • Legal advice regarding any tenancy or lease matter

Before making significant financial decisions based on data from LandlordIQ, consult with a qualified financial advisor, accountant, or attorney. LandlordIQ is not liable for decisions made based on information displayed in the platform.

Intellectual Property

TL;DR — LandlordIQ owns the platform. You own your data. We don't claim any rights to the financial information you enter.

LandlordIQ and its licensors own all intellectual property rights in the LandlordIQ platform, including its software, design, algorithms, and content. These Terms do not grant you any rights to use LandlordIQ's trademarks, logos, or other brand elements.

You retain full ownership of all data you enter into LandlordIQ — your property details, transaction records, uploaded documents, and all other content you create. You grant LandlordIQ a limited license to store, process, and display your data solely for the purpose of providing the service to you.

We will never claim ownership of your financial data or use it for purposes beyond operating LandlordIQ.

Termination

TL;DR — You can close your account anytime. We can suspend accounts that violate these Terms. Either way, you can export your data.

You may close your account at any time from your account settings. Upon closure, your paid subscription is cancelled and your data will be deleted within 30 days. You may export all your data before closing your account or within 30 days after closure.

LandlordIQ reserves the right to suspend or terminate your account, with or without notice, if we determine that:

  • You have materially violated these Terms
  • Your use of the service poses a security risk or legal liability
  • Your account has been compromised and termination is necessary to protect other users

Where possible, we will notify you before taking termination action and provide an opportunity to export your data.

Limitation of Liability

TL;DR — LandlordIQ is provided “as is.” Our liability to you is limited to the amount you paid us in the 12 months before your claim.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LANDLORDIQ'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID LANDLORDIQ IN THE 12 MONTHS PRECEDING YOUR CLAIM, OR (B) $100.

IN NO EVENT SHALL LANDLORDIQ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF BUSINESS OPPORTUNITY.

Governing Law

TL;DR — These Terms are governed by the laws of the State of California. Disputes will be resolved in San Francisco, CA.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of LandlordIQ shall be resolved exclusively in the state or federal courts located in San Francisco County, California. You consent to the personal jurisdiction of such courts.
